Terms and Conditions for the Sales of Goods and Services
These Terms and Conditions (“Terms”) govern the sale of goods and services from Myenergi Ltd, registered company number 10261262, and registered office, Pioneer Business Park, Faraday Way, Stallingborough, Grimsby, DN41 8FF (Myenergi, We, Us, Our) to Our Customer (You), together, the ‘Parties or Party’.
Interpretation
Definitions:
Additional Works: means work that does not fall within the Standard Installation and is that is required in addition thereto, and which may lead to an Additional Cost to the anticipated cost of the Services;
Customer: the person or firm who purchases the Products from Myenergi (also referred to as You);
Order: the Customer’s order for the Product and Services, effective once the full payment has been received by Myenergi as cleared funds;
Product/s: means the Myenergi Zappi;
Services: means the supply and installation of the Product;
Standard Installation: has the meaning given to it in clause 4 below;
Works: means the installation of the Product.
Supply of Products and Services
2.1 Your acceptance of these Terms denotes Your agreement to purchase the Product in accordance with these Conditions.
2.2 We will rely upon the Terms set out herein. Please read them carefully before accepting them.

Verification of Your installation requirements
3.1 Within 48 working hours of receipt of Your deposit as cleared funds as set out in clause 6.1 below, we will contact You to request further information in order to verify the requirements of Your installation.
3.2 We will request information including pictures and descriptions to assess Your installation so that we can confirm that Your Services amount to a Standard Installation.
3.3 It is important You provide the correct information as we will assess Your installation on that information.
3.4 If, after our assessment we deem that Your installation will not amount to our Standard Installation, we will advise You thereof and will provide You with a revised quote (if applicable) before we proceed to book Your installation. If You do not wish to proceed, You may cancel the installation and we will refund Your deposit.
Installation of Products
4.1 We agree to carry out the work with all reasonable skill and care and we will make every effort to complete the work by the time agreed with You. In the event that delays occur for reasons beyond our control, we cannot be held responsible for those delays. If such delays occur, we will notify You and complete the Services as soon as possible.
4.2 If You need to make changes to the agreed installation date, You may do so up to 7 working days of such date. Thereafter, any changes to the agreed installation date may incur an administration fee. Our installations take please between 9 a.m. and 5 p.m., Monday to Friday.
4.3 These Terms cover what is included in Your Standard Installation and what happens if we need to quote for extra works.
4.4 The Standard Installation will be in accordance with current BS7671 wiring regulations and the current IET Code of Practice for Electric Vehicle Charging Equipment Installation, and any relevant subsequent amendments, and includes:
- Up to 15m of cable from EV charge point to consumer unit/meter
- Clear cable installation route
- Cable to be surface mounted – clipped direct
- Routing of the cable through a drilled hole in a wall up to 500mm (20 inches) thick, if this is needed
- An assumption that no groundworks will be required
- Up to 3 metres (10 feet) of plastic conduit to conceal interior wiring
- Installing the Product on a brick or plaster wall, or to another suitable permanent structure
- Installation of Product and cable below 1.8m
- Installation of a new separate consumer unit complete with RCD protection and surge protection
- Supply and installation of one hardwired grid monitoring CT clamp
- Installation of a 7kWh zappi home charger
- Device commissioning i.e., Wi-Fi set up, assistance with Myenergi app set up
- Testing and provision of complete electrical certification of the installation
- It also assumes that correct electrical connections and protections are available on the property and that no civil works, electrical remedial works, or any other trades are required
- the installation point and the cable installation route must be safe, free from asbestos and comply with all applicable health and safety regulations.
4.5 The Standard installation service does not include the following (please note, this is not an exhaustive list):
- Cable run longer than 15m
- Cable run through the floors/lofts etc
- Existing wiring e.g., bonding is not suitably up to date
- Installation of Product in unusual location (please note that the Product is usually installed under stairs, in a garage, utility room, hallway, living room or kitchen)
- Any drilling through walls in excess 500mm i.e. stone walls
- Product installed on a post
- Extending the Wi-Fi signal to the location where Your Product will be installed.
4.6 We allocate 4 hours for Standard Installations. If we can’t complete on the day because of supply related problems or unexpected Additional Works (please see clause 5 below) then we will reschedule an installation date once the Additional Works are complete or our quotation for the Additional Work has been accepted.
4.7 Upon completion of the Product installation, we will give You any warranties, test certificates and other relevant paperwork related to Your Products and installation. This will be contained within the completed installation email which We will send to You.
5. Your Installation obligations
5.1 You agree to provide the following for Our use free of charge to enable the successful installation of the Product:
- Water, washing facilities and toilets;
- Electricity supply;
- Adequate installation space;
- Safe and easy access to Your property from the public highway;
- Easy access to the location within the property where the installation is to take place, which this may involve moving personal belongings from work areas.
5.2 You must ensure that You have a stable, capable and secure internet connection (for example, You may need to extend Your wi-fi network as appropriate).
5.3 You must ensure that You are running the latest firmware across all of Your Myenergi devices.
5.4 We reserve the right to remotely update firmware when We deem necessary, and You shall also manually update firmware when We require You to do so.
5.5 If any parts or units needed to complete the work are delivered to You before our installation, You will ensure that it is stored in a safe, dry environment and will take care not to damage or permit any damage to any such parts. You are responsible for all risk including any damage, or loss of any parts of the system once they are delivered to You and before we install them.
All installation works will be completed by Myenergi’s nominated 3rd party installer.
The owner/Customer or a responsible adult of the age of 18 years or over needs to be present on site for the entire duration of the Installation.
6. Price and Payment
6.1 Subject to clause 7 below, the total cost of the Product and Standard Installation is as set out in the quote You will receive after the assessment of the information You have provided to us. A deposit shall be paid by You upon submission Your enquiry form and acceptance of these Terms. The remaining balance shall be payable upon acceptance of the quotation we will provide after the assessment of Your installation requirements. Upon receipt of the balance as cleared funds, we will contact You to arrange Your installation. Payments must be made by a debit or credit card via secure payment gateway.
6.2 Charges for any Additional Works agreed on site, pursuant to clause 7.2 will be payable in accordance with the provisions of the clause.
7. Additional Works
7.1 On the installation date, if our Installer discovers that Additional Works are required and the Services will cost more than what was originally quoted to the customer (”Additional Costs”), our Installer:
- shall explain the situation to You and provide You with the relevant details;
- will request Your signature to approve the Additional Works and the Additional Costs.
7.2 If You approve the Additional Works and Additional Costs, we shall send You an online payment link immediately, through which You can make the payment for the Additional Costs and the Installer shall then continue with the installation.
7.3 In the event that You do not agree to the Additional Works and/or Additional Costs, our Installer will not proceed with the installation. In this event we will refund Your charges to You, less an administration fee for our reasonable costs.
7.4 In the event that the Installer cannot continue with installation the same day for example, due to a wiring issue or fuse upgrades being required by Distribution Network Operators (DNO) or other issues which render the installation impossible upon that day (“Further Works”), the installation will be aborted.
7.5 Pursuant to clause 7.4 above, our Installer will advise You of any such extra steps that will be required for the installation and of any Additional Costs that may arise with the installation on a second visit.
7.6 We will contact You within 48 hours to discuss the next steps for the second visit for Your installation and will provide You with a revised Additional Costs quote for the Additional Works, within 7 working days.
7.7 Upon receipt of payment as cleared funds for such Additional Works, we will contact You again to re-book in Your installation. Please be aware that the timescales for such second visit may be variable as the installation will depend on what the Additional Works and/or Further Works (which are third-party dependent) are.
8. Right to cancel – Consumers
8.1 If You are a consumer, You may cancel Your Order with us within 14 days after the Order has been made by emailing us at cancellations@myenergi.com. We are unable to accept cancellations by phone. In that event, we will return Your deposit to You in full.
8.2 For all cancellations outside the above 14-day period we reserve the right to charge You any reasonable cost we have incurred in that time.
8.3 For all cancellations requested within 7 working days of the scheduled installation date (including installations booked within the 14 days cooling off period), the cancellation charge will be a minimum of £150 +VAT.
8.4 You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.
8.5 This cancellation policy does not affect Your legal rights – for example, if goods are faulty.
9. Limitation of Liability
Nothing in these terms shall limit or exclude our liability for death or personal injury caused by our negligence.
We shall not be liable for any loss, costs, indirect or consequential damage due to the use and/or misuse of our Products except where this is caused by our negligence.
We shall not be liable for any loss, costs, indirect or consequential damage due to an aborted installation or for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control, nor for any losses which were caused mainly or wholly by Your breach of these Terms.
9.4 Our total liability to You for all other losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the purchase price of the Services hereunder, and is strictly limited to losses that were reasonably foreseeable. Losses are foreseeable where they could be contemplated by You and us at the time Your Order is accepted by us.
10. Warranty
Your Product comes with the Myenergi 3-year Warranty, details of which can be found at this link https://myenergi.com/terms-and-conditions/myenergi-product-warranty. You will also receive an after-sale repair and rectification service in respect of the installation of Products for a period of one year post installation directly from the installer.
11. Office for zero emission vehicles (OZEV)
Details relating to the OZEV and EV ChargePoint grants are set out in the Annex to these Terms.
12. Variation
We reserve the right to make any changes to our Terms for business reasons and insofar as such changes are mandated by law and/or regulation.

Annex to Terms and Conditions
EV ChargePoint Grant
The Office for Zero Emission Vehicles (OZEV) provides the EV Chargepoint Grant for up to £350 (including VAT) towards the cost of a home charger (including installation) eligible customers who are resident in flats and rental properties.
If You would like to apply the grant to Your Order, we can make the application on Your behalf. You must ensure that You provide us with complete documentation as requested, before our final quote including grant deduction may be submitted to You.
Please note:
- You must provide us with full and complete documentation for the purposes of the grant application in order that we may verify Your eligibility therefor. If You do not do so, Your final quote will not deduct the amount of the grant. balance.
- You remain wholly liable for any costs we may incur as a result of the supply of false, inaccurate or incomplete information to us in relation to the OZEV EV Chargepoint.
- If You provide false or incorrect information which results in Your OZEV grant claim being declined, You will be liable to us for the amount that would otherwise be covered by the OZEV grant.
- We will endeavour to process Your OZEV claim within the framework and the guidelines provided by OZEV. However, if OZEV rejects Your claim for reasons outside of our control, we will issue You an invoice for the amount that we would have otherwise claimed from OZEV.
- Myenergi will not be liable for any loss arising from any changes in the grant rules and/or eligibility criteria.

Summary of OZEV Grant (the “Grant”) terms:
The Grant is available to people who own and live in a flat and/or people living in rental accommodation (flats and single-use properties);
- The Grant is capped at £350 (including VAT) per installation;
- The main requirement to qualify for the Grant is that the applicant person owns, leases or has ordered a qualifying vehicle and has designated private off-street parking at his/her property;
- The Grant is only award-able if the applicant chooses an EVHS installer to install its EV Chargepoint;
- The installer will check whether the applicant qualifies for the Grant and will make the application on the applicant’s behalf;
- The Grant can only be used for retrofit (existing) properties that are currently occupied;
- The Grant cannot be claimed retrospectively;
- Only one claim per vehicle can be made, even if You own more than one and home. single customer can only claim the Grant once in total;
